Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

1. Who we are

Seavaint Health Nursing Inc, dba Seavaint Health (NPI 1578401873), is a California-only telehealth practice. We are a "covered entity" under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA").

2. Our duties

We are required by law to maintain the privacy of your protected health information ("PHI"), provide you with this Notice of our legal duties and privacy practices, follow the terms of this Notice, and notify you in the event of a breach of unsecured PHI.

3. How we may use and disclose your PHI

Without your written authorization, we may use or disclose your PHI for:

  • Treatment. To provide, coordinate, or manage your healthcare, including with other providers involved in your care.
  • Payment. To bill for services, including coordination with Headway, Inc. for psychiatry visits, and to verify insurance eligibility.
  • Health care operations. Quality assessment, training, accreditation, business management, and similar activities.
  • As required by law. Including reporting obligations under California and federal law.
  • Public health and safety. Including disease prevention, child or elder abuse reporting, and serious threats to health or safety.
  • Other limited circumstances. Including judicial or administrative proceedings, law enforcement, organ donation, research with appropriate safeguards, workers’ compensation, military and veteran activities, and national security activities, all as permitted by law.

4. Uses and disclosures that require your authorization

Most uses and disclosures of psychotherapy notes, uses for marketing, and disclosures that constitute a "sale" of PHI require your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

5. Your rights

  • Right to inspect and copy your medical record, subject to limited exceptions.
  • Right to request amendment of your record.
  • Right to an accounting of certain disclosures.
  • Right to request restrictions on certain uses and disclosures. We are not required to agree to all requests, but we will agree to restrict disclosures to a health plan when you pay out of pocket in full for the service.
  • Right to confidential communications at an alternative location or by alternative means.
  • Right to a paper copy of this Notice on request.
  • Right to be notified in the event of a breach of unsecured PHI.

6. California-specific rights

California law provides additional privacy protections, including the Confidentiality of Medical Information Act (CMIA). We follow more protective state requirements where they apply.

7. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.

8. Changes to this Notice

We may change this Notice at any time. Changes apply to all PHI we maintain. The current Notice is always available on this Site.
