These Terms of Use ("Terms") govern your use of the website at seavaint.com (the "Site") operated by Seavaint Health Nursing Inc, doing business as Seavaint Health ("Seavaint", "we", "us"). By using the Site, you agree to these Terms.
1. Informational use only
The Site provides general information about Seavaint Health and our services. Content on the Site is not medical advice and is not a substitute for evaluation, diagnosis, or treatment by a qualified healthcare professional. Reliance on Site content is at your own risk.
2. No emergency services
The Site, telehealth visits, and patient messaging are not appropriate for medical or mental health emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room. For mental health crises, call or text 988.
3. California-only telehealth
Seavaint Health provides telehealth services to patients located in California at the time of the visit. We do not provide care to patients located outside California.
4. No doctor-patient relationship through the Site
Use of this Site does not create a clinician-patient relationship. A clinician-patient relationship is established only after intake, evaluation, and acceptance of care through our patient portal.
5. Bookings, intake, and clinical information
Booking, intake, and clinical messaging occur through our patient portal. Information submitted to the portal is governed by our Notice of Privacy Practices, Telehealth Consent, and applicable business associate agreements.
6. Headway (psychiatry billing)
Psychiatry services may be billed through Headway, Inc. Your relationship with Headway is governed by Headway’s separate terms and privacy policy.
7. Intellectual property
All content on the Site, including text, graphics, logos, and software, is owned by or licensed to Seavaint and is protected by applicable intellectual property laws. You may not reproduce, redistribute, or modify Site content without our written permission.
8. User conduct
You agree not to misuse the Site, including attempting to interfere with its security, scraping content for unauthorized purposes, or impersonating any person or entity.
9. Disclaimers
The Site is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
10. Limitation of liability
To the maximum extent permitted by law, Seavaint will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded by law.

You agree to defend, indemnify, and hold harmless Seavaint and its officers, directors, and personnel from any claims arising out of your use of the Site or your violation of these Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in California.
